JUUL Settlement Update
Status Letter |
Dear Client,
Please review this entire letter for important information about the status of your JUUL settlement. As you are aware the Settlement Administrator has determined the final value is $0.77476 per point. Your initial payment of 86.52% will be based on your Total Base Points Award. At this time, we are working with the Archer, a third-party company to give our clients an option of digital payment. We request that you look out for communication from Archer, as they will be reaching out to our clients to gather additional information. As we are working with Archer, we request that you remain patient as we work diligently to get you your initial JUUL payment. | | |
Explanation of Pending Liens: |
As you may recall from our previous letters, if a private health insurance company or a government health insurance program paid for any portion of your JUUL-related medical expenses, then they can assert a lien against your recovery to try and recoup their payments. As the insured, you are responsible for these liens. Under the terms of the settlement, a lien resolution administrator has been appointed to help negotiate and resolve these liens.
Due to the ongoing process of verifying and resolving government and private liens, we may need to hold back a prescribed amount of your settlement until those liens are confirmed and resolved per the settlement agreement. These holdbacks will only be temporary. If that is to happen, we will notify you as additional funds become available after your liens are finalized. Please keep this in mind when reviewing your expected amount in the future once settlement payments have been made to you. If you do not see one or both lien holdback amounts listed on your disbursement schedule, your particular claim has been found to have no liens. | | |
Government Benefit Disclaimers: |
Receipt of settlement funds can impact eligibility for certain needs-based government benefits, including Medicare, Medicaid, Social Security, and student financial aid. | | |
Cases dealing with Minors’ |
Settlement funds for clients who are still minors cannot be distributed until Court approval of each minor’s settlement. At this time we are waiting to hear from the Special Master regarding details of her assessment. Liens will need to be resolved in minors; cases before the process can proceed. | | |
Explanation of Altria Settlement: |
As you are aware, in July 2023, Altria Group and the Plaintiffs reached a new settlement agreement. This is a completely different settlement than the JUUL Settlement. Like the JUUL settlement, there were several requirements to be eligible to participate in the Altria Settlement.
The requirements were emailed and texted to you. The deadline to enroll in the Altria settlement was January 2, 2024. Failure to sign the forms would have disqualified you from enrolling in the Altria settlement. Like the JUUL settlement, we are working with the Settlement Administrator to ensure your payments get out to you as soon as possible. | |
Explanation of Future Payments: |
The second JUUL payment (the next 3.87% installment) is anticipated to be due on December 15, 2024. This payment will likely be dispursed by the Settlement Administrator to each firm by early to mid 2025.
The third (4.80%) and fourth (4.80%) JUUL payments are due in December 2025 and December 2026. As a reminder, pursuant to the Settlement Agreement, JUUL will receive a prepayment discount on the remaining payments if it chooses to prepay. While we have no reason to believe this will occur, it is possible that JUUL does not make the remaining payments or that they are reduced by the prepayment discount. | | |
